Terms of Service

1. The Service

NewMinecraftServers is a directory of Minecraft servers with guides and tools for players and server owners. Listings are compiled from public sources and from status information that servers report when we ping them. We work to keep listings accurate, but player counts, status, versions and other details can be out of date or wrong, and we do not verify or endorse any server.

We may change, add or remove features at any time. If we discontinue a paid feature you have paid for, we will give you reasonable notice and a prorated refund of any prepaid amount you cannot use.

2. Eligibility and accounts

You can browse without an account. To create one you must be at least 13 years old, or older if your country requires it, and if you are under the age of majority where you live, you must have a parent or guardian's permission.

Give accurate information, keep your password secure, and tell us promptly if you think your account has been compromised. You are responsible for activity on your account. You may stop using the Service at any time and ask us to delete your account.

3. Third-party servers and sites

Minecraft servers listed here are operated by independent third parties. We do not control them and are not responsible for their content, rules, availability, security, purchases made on them, or how their operators treat you or your information. The same applies to websites, Discord servers, voting sites and other services we link to. Your use of them is at your own risk and under their own terms.

Never share your Minecraft, Microsoft or other account passwords with a server or site that asks for them.

4. Acceptable use

When using the Service, you agree not to:

• break the law, or infringe anyone's intellectual property, privacy or other rights;
• submit false or misleading information, impersonate a server or person, or claim a server you are not authorized to manage;
• manipulate rankings, votes, player counts or other metrics, including with bots, scripts or fake accounts;
• use the Service to attack, overload or gain unauthorized access to any server, network or account, including ours;
• scrape or copy the Service in bulk, or access it by automated means other than our documented public API within its rate limits;
• interfere with the Service's security, rate limits or normal operation, or try to reverse engineer non-public parts of it;
• upload or link to malware, or content that is sexual involving minors, hateful, harassing or otherwise harmful.

We may remove content, limit access or suspend accounts that break these rules.

5. Server owners and listings

If you claim or manage a listing, you confirm that you are authorized to act for that server and that the information you provide is accurate and lawful. You keep ownership of what you submit, such as descriptions, images and links, and you give us a worldwide, non-exclusive, royalty-free license to host, display, reproduce and adapt it for operating and promoting the Service, for as long as it is listed.

We decide what appears on the Service and in what order, and we may edit or remove listings, for example if they are inaccurate, offline for long periods, or break these Terms. To correct or remove a listing for a server you run, email [email protected].

6. Voting

• You may vote for each server once a day (20 hours after your last vote), for up to 5 servers a day, using the Minecraft username you actually play with. On servers that are not cracked, the username must belong to a real Minecraft account. Only a person may vote; votes cast by bots, scripts, paid services or alternate accounts are not allowed.
• We may refuse, void or remove votes, reset counts, or remove a listing from rankings if we believe votes were manipulated, including by the server's owner or staff. Voided votes do not count toward rankings.
• In-game rewards for voting are given by each server, not by us. We send the vote to servers whose owners have set this up, but we do not promise that any reward will arrive, and we are not responsible for what a server offers or withholds.
• Server owners must not require, sell or pay for votes, or offer rewards in a way that encourages fake votes.

7. Paid features, billing and refunds

Some features may require payment. Prices, what is included and the billing period are shown before you buy. Payments are processed by Stripe, subject to Stripe's terms. Prices may include or exclude taxes depending on where you are; any taxes due are shown at checkout.

• Subscriptions renew automatically at the end of each billing period at the then-current price until you cancel. We will tell you before a price change applies to your subscription.
• Cancelling: you can cancel any time from the billing page. Cancellation takes effect at the end of the current paid period, and you keep access until then.
• Refunds: payments are non-refundable except where required by law or stated here. If you were charged in error, or a paid feature did not work as described and we could not fix it, email us within 30 days of the charge and we will make it right, including with a refund where appropriate.
• Failed payments: if a renewal payment fails, paid features may be paused until it is resolved.

Nothing in these Terms limits any right you have under consumer protection law, such as a right to withdraw from a purchase.

8. Public API

Our public API is provided free of charge, as is, and may change or be rate limited. Do not use it to build a copy of the Service or to overload it. We may block keys, applications or addresses that misuse it.

9. Our content and trademarks

The Service, including its design, text, graphics and code, belongs to NewMinecraftServers or its licensors. You may use it for personal, non-commercial purposes and share links to it. Server names, logos and descriptions belong to their respective owners.

Minecraft is a trademark of Mojang Synergies AB. This is not an official Minecraft product and is not approved by or associated with Mojang or Microsoft. The Monocraft typeface is used under the SIL Open Font License.

10. Copyright and content complaints

If you believe content on the Service infringes your copyright or other rights, email [email protected] with the content's location, a description of your work or right, your contact details, and a statement that you believe in good faith the use is not authorized. We will review it and remove content where appropriate.

11. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not promise the Service will be uninterrupted, error-free or secure, or that any listed server is safe, available or as described.

12. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill or in-game items, arising from your use of the Service or any third-party server or site, even if we were told they were possible. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim and 50 US dollars.

Some jurisdictions do not allow these exclusions or limits, so they apply to you only as far as the law allows. Nothing here limits liability for fraud, gross negligence, willful misconduct, or death or personal injury caused by negligence.

13. Indemnity

If you use the Service for business purposes, you agree to defend and indemnify us against third-party claims, and the related costs, arising from your content, your server, or your breach of these Terms.

14. Suspension and termination

You can stop using the Service at any time. We may suspend or end your access if you break these Terms, if required by law, or to protect the Service or its users. Where reasonable we will tell you why. If we end a paid subscription without cause, we will refund the unused portion. Sections that by their nature should survive, such as ownership, disclaimers and limits of liability, continue after termination.

15. Changes to these Terms

We may update these Terms. We will revise the "Last updated" date and, for material changes, tell account holders by email or on the site before they take effect. Continuing to use the Service after changes take effect means you accept them.

16. Disputes and general terms

If you have a problem with the Service, please contact us first at [email protected]; most issues can be solved quickly that way. These Terms are governed by the laws of the jurisdiction where NewMinecraftServers's operator is established, without regard to conflict-of-law rules, and you keep any protections the laws of your own country give you.

If part of these Terms is unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. You may not transfer your rights under these Terms without our consent; we may transfer ours as part of a merger, acquisition or sale of assets. These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service.
